When the Franchise Tax Board (FTB) or the California Department of Tax and Fee Administration (CDTFA) issues an unfavorable decision, the dispute isn’t necessarily over. The Office of Tax Appeals (OTA) is an independent state body created in 2017 to hear these challenges, separate from the agencies that issued the original assessment. How an OTA Appeal Works

The right to appeal is triggered when FTB’s protest process or CDTFA’s Appeals Bureau affirms an assessment and issues a Notice of Action or Decision. That notice starts a 30-day clock, though a denied refund claim allows 90 days. Appeals can be filed through the Office of Tax Appeals Portal (OTAP) or by submitting OTA Form L-01, and must include a copy of the notice being appealed.

Once an appeal is filed, FTB or CDTFA has 60 days to submit its opening brief, and the taxpayer then has 30 days to file a reply. Each appeal is assigned to a panel of three Administrative Law Judges (ALJs) who review the record and issue a written decision. If the disputed amount falls below a specified dollar threshold, a taxpayer may opt into the Small Case Program, which assigns the matter to a single ALJ under a simplified process.

A few procedural points worth noting before filing:

  • Oral hearing or written record: Taxpayers can request an oral hearing or have the appeal decided on the written record alone. OTA issues a written decision either way.
  • Hearing locations: OTA hearings are held in Sacramento, Fresno, and Los Angeles. There is no local venue in Marin County.
  • Deemed denial: If FTB hasn’t acted on a refund claim within six months, that inaction can be appealed as a deemed denial without waiting for a formal notice.

Why Representation Matters at the OTA Stage

OTA describes its process as informal and notes that taxpayers don’t need special training to present a case. That’s accurate as a procedural statement. What it doesn’t address is the gap between filing an appeal and making a persuasive one. The briefing schedule is fixed, the ALJ panel arrives with the agency’s position already on record, and arguments that succeeded at the audit stage don’t automatically carry weight at OTA.
